1. Faherty

The Faherty Monthly Product Sweepstakes (the “Sweepstakes”) is by Faherty Brand, LLC, with an address at 180 Maiden Lane, 40th Floor, New York, NY, 10038 (“Faherty”).

2. Agreement to Official Rules

By entering or participating in the Sweepstakes, each entrant agrees to be bound by these Official Rules, Faherty’s decisions, and the Faherty Loyalty Program Terms, which are final and binding in all matters relating to the Sweepstakes. If there is a conflict between these Official Rules and the Faherty Loyalty Program Terms with respect to the Sweepstakes, these Official Rules will control for this Sweepstakes only.

3. Eligibility

The Sweepstakes is open only to legal residents of the fifty United States and the District of Columbia who are at least eighteen (18) years old or the age of majority in their state of residence, whichever is older, at the time of entry, and who are members of Faherty’s Loyalty Program. Loyalty Program participants with negative Stamp balances are not eligible to enter the sweepstakes and such entries will be removed from consideration. 

Employees, officers, and directors of Faherty, its parents, subsidiaries, affiliates, and prize suppliers, and each of their immediate family members and household members, are not eligible to enter or win.

The Sweepstakes is subject to all applicable federal, state, and local laws and regulations.

4. Sweepstakes Period

Each monthly sweepstakes begins at 12:00:00 a.m. Eastern Time on the first day of the applicable calendar month and ends at 11:59:59 p.m. Eastern Time on the last day of that calendar month (each, a “Monthly Sweepstakes Period”). Each Monthly Sweepstakes Period is a separate sweepstakes and is subject to these Official Rules as posted for that Monthly Sweepstakes Period. Faherty’s computer is the official timekeeping device for the Sweepstakes.

Entries do not carry over from one Monthly Sweepstakes Period to another. Eligible Loyalty Program participants will have an opportunity to enter at the start of each Monthly Sweepstakes Period.

5. How to Enter

There are two ways to receive entries during each Monthly Sweepstakes Period.

A. Free Entry. Each eligible Faherty Loyalty Program participant may claim one (1) free entry into the applicable Monthly Sweepstakes Period. No purchase, payment, loyalty point redemption, activity, challenge completion, or other action is required to claim or use this free entry.

B. Bonus Entry Block Through Loyalty Point Redemption. During a Monthly Sweepstakes Period, an eligible Faherty Loyalty Program participant may redeem exactly fifty (50) loyalty points to receive one block of fifty (50) entries into that Monthly Sweepstakes Period. The bonus entry block is all-or-nothing. No partial bonus entry block is available.

Loyalty points may be earned through both qualifying purchases and Challenges, including purchase-free weekly challenges. Purchase-free weekly challenges are available weekly and may include activities such as uploading an outfit photo, sharing how the member made a positive environmental impact, or sharing a moment of kindness.

Completing weekly challenges during a Monthly Sweepstakes Period provides enough loyalty points to redeem for the bonus entry block without making any purchase.

C. Limit: Each Faherty Loyalty Program participant is limited to one free entry and one bonus entry block per Monthly Sweepstakes for a total of fifty-one (51) entries per Monthly Sweepstakes Period, regardless of method of entry or Loyalty Program point-earning activity.

6. No Purchase Necessary; Equal Odds

No purchase is necessary to enter or win the Sweepstakes. A purchase will not increase a Faherty Loyalty Program participant’s chances of winning. Participants may receive the maximum number of entries available for a Monthly Sweepstakes Period without making a purchase by joining the free Faherty Loyalty Program, claiming the free entry, completing enough purchase-free weekly challenges to earn at least fifty (50) loyalty points, and redeeming exactly fifty (50) loyalty points for the bonus entry block.

All eligible entries received for a Monthly Sweepstakes Period have an equal chance of winning.

7. Loyalty Points

Faherty Loyalty Program points do not have cash value, are not legal tender, are not redeemable for cash, and may be used only as expressly provided in the Faherty Loyalty Program Terms, available at https://fahertybrand.com/pages/terms-and-conditions-for-postcard-by-faherty, and these Official Rules. Loyalty points redeemed for bonus entries will be deducted from the participant’s Loyalty Program account and will not be returned, refunded, or reinstated except in Faherty’s sole discretion or as required by law. Faherty may verify completion of purchase-free weekly challenges and may reject, reverse, or remove points or entries obtained through fraud, automation, abuse, violation of these Official Rules, violation of the Faherty Loyalty Program Terms, or other improper means, or where the Member has a negative Stamp balance.

8. Weekly Challenge Content

If a weekly challenge requires a photo, written submission, or other user-generated content, the submission must be original to the entrant or submitted with all necessary rights and permissions. Submissions may not include content that is unlawful, defamatory, obscene, hateful, threatening, harassing, invasive of privacy, infringing, misleading, or otherwise inappropriate, as determined by Faherty in its reasonable discretion. 

Weekly challenge submissions are used only to determine whether the member completed the applicable challenge. Sweepstakes winners are selected by random drawing, and submissions are not judged for creativity, quality, skill, or merit.

By submitting content, the entrant represents that the entrant has obtained all rights, consents, and permissions necessary to submit the content and to grant the rights described in these Official Rules, and grants Faherty a non-exclusive, worldwide, royalty-free right to use, reproduce, display, publish, and adapt the submission in connection with administration of the Faherty Loyalty Program, the Sweepstakes, and Faherty’s marketing, subject to Faherty’s Privacy Policy and applicable law. Faherty has no obligation to use any submission. 9. Winner Selection

On or about five (5) business days following the end of each Monthly Sweepstakes Period, Faherty or its designee will select and notify by email the potential winner in a random drawing from among all eligible entries received for that Monthly Sweepstakes Period and will notify the winner by email. The odds of winning depend solely on the number of eligible entries received for the applicable Monthly Sweepstakes Period.

10. Prize

For each Monthly Sweepstakes Period, Faherty will award one eligible, in-stock Faherty apparel product available at fahertybrand.com, with a maximum retail value of $250 (“Prize”). 

Prizes are non-transferable, non-assignable, and may not be redeemed for cash, except in Faherty’s sole discretion. Faherty may substitute a prize of equal or greater value if an advertised Prize becomes unavailable for any reason. Any difference between the stated ARV and actual value of a Prize will not be awarded.

11. Winner Notification and Verification

The potential winner will be notified by email, at the address that is associated with the potential winner’s Faherty Loyalty Program account. 

To claim the prize, the potential winner must reply to the email within five (5) calendar days with their preferred eligible Faherty apparel product, including size and color, and their shipping address. The prize may only be one eligible, in-stock Faherty apparel product available at fahertybrand.com, with a maximum retail value of $250. If the retail price of the selected item is less than $250, the remaining balance will be forfeited and will not be paid, credited, carried over, or applied to any other item.

The Prize may not be returned for a refund, store credit, gift card, cash, points, or any other form of value. The Winner may request one (1) size exchange for the same product within fourteen (14) days after delivery, subject to availability. If the requested size is unavailable, Faherty may, in its discretion, provide a substitute product of equal or lesser value. After one exchange or substitute product has been provided, the prize will be deemed fulfilled, and no further returns, exchanges, substitutions, credits, or compensation will be provided. This section does not limit Faherty’s ability to replace damaged, defective, misdelivered, or materially misdescribed merchandise.

 If Faherty does not receive the potential winner’s response within five (5) calendar days of the date the prize notification is sent, or if the potential winner does not complete the required claim steps within the time stated in the Official Rules, the prize may be forfeited and an alternate potential winner will be selected.

No purchase or payment is required to claim the prize. Standard shipping will be provided by Faherty. Faherty may require a potential winner to confirm eligibility and, where lawful, complete a liability release, publicity release, or other documentation reasonably necessary to administer the Sweepstakes and award the Prize. If a potential winner is found to be ineligible, fails to comply with these Official Rules or the Faherty Loyalty Program Terms, fails to timely respond, fails to provide required information or documentation, declines the Prize, or cannot be contacted, the Prize may be forfeited and Faherty may select an alternate potential winner from among the remaining eligible entries.

12. Taxes

Each winner is solely responsible for all federal, state, and local taxes and all costs and expenses, aside from shipping, associated with accepting, claiming, receiving, or using a Prize that are not expressly stated in these Official Rules as being provided by Faherty. Faherty may issue tax reporting forms and may require a winner to provide tax information as required by law.

13. Privacy

Information collected in connection with the Sweepstakes will be used in accordance with Faherty’s Privacy Policy, available at https://fahertybrand.com/pages/privacy-polic], and may be used to administer the Sweepstakes, verify eligibility, contact entrants and winners, fulfill Prizes, comply with legal obligations, and operate the Faherty Loyalty Program.

14. General Conditions

Faherty may disqualify any person who Faherty determines, in its reasonable discretion, has violated these Official Rules or the Faherty Loyalty Program Terms, tampered with the operation of the Sweepstakes, acted in an unsportsmanlike or disruptive manner, attempted to obtain entries by fraud, automation, bot, script, multiple accounts, or other improper means, or attempted to undermine the legitimate operation of the Sweepstakes.

Faherty is not responsible for lost, late, incomplete, invalid, unintelligible, misdirected, delayed, garbled, corrupted, or failed entries, submissions, notifications, or communications; technical, network, computer, server, provider, software, hardware, or other failures; unauthorized human intervention; inaccurate entry information; or other errors or problems of any kind, whether human, mechanical, technical, electronic, typographical, printing, or otherwise.

If the Sweepstakes is impaired for any reason, Faherty may, in its discretion, cancel, suspend, modify, or terminate the affected Monthly Sweepstakes Period and, if feasible, select winners from among eligible entries received before the impairment.

15. Release and Limitation of Liability

By entering or participating in the Sweepstakes, each entrant releases and holds harmless Faherty, its parents, subsidiaries, affiliates, advertising and promotion agencies, prize suppliers, and each of their respective officers, directors, employees, representatives, agents, successors, and assigns from and against any claim, liability, loss, damage, cost, or expense arising out of or relating to participation in the Sweepstakes or acceptance, possession, use, misuse, or nonuse of any Prize.

To the fullest extent permitted by law, Faherty will not be liable for indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or relating to the Sweepstakes or any Prize.

16. Disputes

Except where prohibited by law, each entrant agrees that all disputes, claims, or causes of action arising out of or relating to the Sweepstakes or any Prize will be resolved in accordance with the dispute resolution provisions in the Faherty Loyalty Program Terms, which are incorporated into these Official Rules by reference. Before bringing a formal claim, entrants and Faherty must first try to resolve the dispute through the mandatory informal notice and negotiation process described in the Faherty Loyalty Program Terms. If unresolved, disputes generally must be brought individually in binding arbitration or, if eligible, small claims court. Class, collective, consolidated, representative, and jury proceedings are waived to the fullest extent permitted by law. Certain intellectual property and confidentiality claims may be brought in court for injunctive relief. Claims generally must be commenced within one year, subject to applicable law. If there is a conflict between these Official Rules and the Faherty Loyalty Program Terms with respect to the Sweepstakes, these Official Rules will control for this Sweepstakes only. ADD LINK 

17. Winners List

To request the name of the winner for a Monthly Sweepstakes Period, send a self-addressed, stamped envelope to: Faherty Brand, LLC, Loyalty Program - Monthly Product Sweepstakes, at 180 Maiden Lane, 40th Floor, New York, NY, 10038 or hello@fahertybrand.com. Requests must be received within 60 days after the end of the applicable Monthly Sweepstakes Period.
